| I got allotment on BHS 2006 for 120sqm in Jan, 2007 under Greater Noida Ind. Authority(GNIDA). GNIDA has promised to give possession by 3 years of allotment and a clause in Form as not to give PTM to anyone before possession. LIC and HDFC were only banks to give loan in such case. I applied for a loan of Rs. 20 lakh from LIC at an interest rate of 8.75% for this property worth Rs. 22 lakh and received maximum 85% of it as Rs. 18, 70, 000 without any security which needs to be surrender after registry in terms of my house documents. I have following query: 1. My EMI is going according to Rs. 20 lakh and not received amount ie. Rs 18.7 lakh. Is it legal to charge for the amount I have not received yet. 2. LIC has said that they will give the remaining amount during registry. Am I applicable for the interest on the remaining amount? (Ajay Kumar) | |

| It is not clear from your question whether you had opted for full EMI repayment or Pre-EMI repayment. If you have opted for full EMI repayment before possession of the property, it is right on the part of the bank to charge full EMI for the full loan amount even though only partial disbursement has happned. If the your agreement with the bank is for pre-EMI, then the bank should be charging interest only for the disbursed amount as pre-EMI. Please go through your loan agreement carefully. | |
