| I took a loan from a co-operative bank for a car, I foreclosed the loan before tenure. I was also a guarantor to someone for computer loan and party is defaulter now. Can bank withhold the NOC to RTO for removing HP termination to my vehicle? Can I claim damages to bank for illegally withholding services related to my loan? | |

| Since you are a guarantor for the personal loan taken for a computer, and the party is a defaulter now; you may have to pay off the loan or the bank may rightfully withhold the NOC to RTO for removing HP termination to your vehicle. The liability as a guarantor is equal to the liability as a borrower. The bank has a right to set off its dues (and guaranteed amounts are dues) against any other funds or property it holds from you. | |
